1. Acceptance of these terms
By accessing or using Datagene services, you agree to these terms. Where you use the service for an organisation, you confirm that you have authority to act for that organisation.
2. Our services
Datagene provides data engineering, analytics, governance, reporting, integration and software services. Available features may change as the service develops.
Specific commercial arrangements may also be governed by an order form, proposal, statement of work or separate customer agreement.
3. Accounts and security
Users must provide accurate account information, keep credentials secure and notify Datagene promptly of suspected unauthorised access.
Organisations are responsible for users they authorise and for managing access when staff members or contractors change roles.
4. Third-party connections
Customers may choose to connect third-party services. The customer confirms that it has authority to connect each account and to allow Datagene to process the associated information.
Third-party platforms remain governed by their own terms, policies, availability and technical restrictions. Datagene does not control those platforms.
5. Customer data
Customers retain ownership of information they provide or connect to Datagene.
The customer grants Datagene a limited right to host, copy, transform, analyse and otherwise process that information only as needed to provide, secure and support the agreed services.
6. Acceptable use
Users must not use Datagene to:
- break any law or infringe another person’s rights;
- access data or accounts without proper authorisation;
- send unlawful, deceptive, abusive or harmful content;
- introduce malware or interfere with service security;
- circumvent platform limits or access controls;
- misrepresent generated content as independently verified fact.
7. Generated content and analytics
Reports, predictions, recommendations and AI-generated content may contain errors or require further context.
Customers are responsible for reviewing outputs before making business decisions, publishing content or submitting information to third parties.
8. Intellectual property
Datagene retains ownership of its software, templates, systems, branding, documentation and pre-existing intellectual property.
Unless a separate agreement states otherwise, customers may use outputs created specifically for them for their internal business and marketing purposes.
9. Fees and payment
Charges, payment dates, taxes and renewal arrangements will be specified in the applicable proposal, order form or subscription plan.
10. Availability and changes
We aim to provide a reliable service but cannot guarantee uninterrupted availability. Maintenance, security incidents, internet failures and third-party platform changes may affect access.
11. Suspension and termination
Access may be suspended or terminated for non-payment, security risk, unlawful activity, material breach or misuse of the service.
Customers may stop using the service and may disconnect integrations using the available account controls or by contacting Datagene.
12. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that limitation, Datagene is not responsible for indirect loss, lost profits, decisions made solely from unverified outputs or failures caused by third-party platforms.
13. Governing law
Unless a separate written agreement states otherwise, these terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales.
